公案小说和侦探小说是中国近代小说中的重要小说流派。虽然其文学渊源不同,却几乎同步产生,且在表现对象、叙事特征、文化观、道德观等方面具有一致性。同时,人物设置的主从与互补、文本内蕴的人治与法制、叙事进程的客观呈现与主观推断等方面,则凸显出二者的差异。比较研究二者异同,对于认知其流派特征,研究其嬗变规律,把握其叙事特征,进而阐释其独特内蕴,定位其文学史价值等,均大有裨益。作为中国近代小说史上生成于本土和借鉴外来文学形式的两个小说流派,公案小说和侦探小说的存在恰恰凸显了近代小说中外兼容的过渡特色。

英文摘要：

Legal case novels and detective novels are important genre of Chinese modem novels. Although their literary origin is different, they came into being synchronously and there is consistency in performance object, narrative characteristics, concept, morality. Meanwhile, it is showed the differences in the character of primary and secondary and complementation, rule of man and legal institution in text intrinsic, the narrative process of present objective and subjective inference, etc. Comparative study on both similarities and differences, helps to cognitive the genre features, study the evolution law, master its narrative features, and then explain its unique connotation, positioning its literature value and so on. The two novel genre of Chinese modem novels, one generated in the native and the other draw lessons from foreign literature, their existence shows the compatible transition of modem novels.
