英文摘要：

The purposes of this paper are to explore legal problem and suggestion of the peasant＇ s reclamation rights in the process of linked change of rural-urban construction land. The results indicate that the peasant have not enough legal main body position. Some restrictive factors violated the rights of farmers land reclamation. Local governments monopolize land reclamation. The quality of reclamation is not good enough so it would hurt farmers＇ interests. The paper concludes that the farmers must have given reclamation statutory rights and main body status. Setting restrictive conditions for homestead. Curb the pursuit of economic interests from reclamation. The peasant should be given land reclamation supervision right. We should establish an effective supervision mechanism and establish peasant rights representative system.
