魏晋南北朝"礼"与"法"的结合,既是西汉以降的继续,也是这个过程发展的新阶段。魏晋南北朝时期的礼法概念不同于两汉,不但指国家礼仪制度和法律,还包括家礼和家法。与礼法概念相同的还有"礼律"。礼律并列的概念更是直接地反映了礼法的结合。礼法初步结合大致发生在汉末三国,紧密结合发生在魏晋以及北朝北魏孝文帝太和以后。礼法紧密结合的一个突出特点,表现为二者在思想认识、法律制定、司法实践等方面的全方位结合。魏晋南北朝时期礼法结合的紧密程度是前所未有的,二者你中有我,我中有你,连成了一个有机的整体,有机结合可以说是魏晋南北朝礼法结合区别于前代的特点,具体表现为礼制执行的刚性化,刑事案件中的礼法结合,不因礼废法,法不离礼独行几个方面。礼与法的有机结合无论在礼制发展史还是法律发展史上都是一个非常重要的事情。自此以后,这个有机体就变得牢不可破,一直影响至今。
The combination of"ritual"and"law"in Wei, Jin and South-North Dynasties is the succession from West Han Dynasty and a new stage in the development process. The concept of ritual and law of that time is different from Han Dynasty, which refers to national ritual system and law as well as family ones. Similar to ritual and law, there is the concept of "ritual and regulations",the juxtaposition of which reflects directly the combination of ritual and law. The early combination happens at the end of Han Dynasty and the beginning of Three Kingdoms period, and the further combination happens in Wei, Jin and Emperor Xiaowen of North Wei of North Dynasty period. One characteristic of the further combination of the two shows in the combination of the two in thinking pattern, legal compilation and judicial practice. The close combination at that time is unprecedented,forming a whole with one in the other. The organic combination is one feature distinguishing it from the previous dynasties, embodying in the forceful implementation of the system, the combination in criminal case, law enforcement in spite of ritual and legal practice with consideration of ritual. The combination is very important in the development of both ritual and legal system, which can not be separated and influence till today.
