多语制是欧盟运行机制所遵循的一项基本原则,对于欧盟的法律制定、条法解读乃至整个联盟范围内的法律一体化都有深刻影响。文章以欧盟刑事司法领域为例,探讨了多语制对欧盟法律一体化进程产生的具体影响,主要聚焦于多语制对于欧盟纵向的法律规范建构和横向的法律体系融合所造成的障碍。我们认为,多语制所带来的负面影响将长期伴随欧盟的法律一体化进程,但不会对这一进程造成根本性的障碍,欧盟可以采取改革工作机制等方式进行改善。
As a founding principle of EU, the muhilingualism lays profound influences on EU law making and interpreting, and even the EU legal integration as a whole. This article takes the area of criminal justice as an example, analyzes the role that the muhilingualism plays in the process of EU legal integration, with a focus on the establishment of EU legal norms and its materialization and implementation in the member states. It concludes that the multilingualism may permanently hinder the process of EU legal integration, though not in a fatal way ; the practical obstacles, however, can be overcome gradually by functional mechanism reforms of EU.
