Balancing of interests is the basic spirit in modern copyright law, and is also the guide to amend the copyright law and the design of copyright system. Viewed from the history of copyright system, it is a gradual process in the establishment of the doctrine of balancing of interests, and it is successful that copyright law makes a balance between the interests of authors and the social pubic interests. The basic principle and requirement of balancing of interests in copyright law is the proper level of protection, pursuing the balance between the interests of copyright owners and the public interests, and making the public access to copyrighted works properly.
