老年人犯罪从宽处罚问题是当前刑事法研究的重大课题之一。《刑法修正案（八）》在从轻或减轻、缓刑、免死三个方面对老年人犯罪从宽处罚。老年人犯罪从宽处罚具有合理性。应当从降低老年人犯罪从宽暨免死的年龄、重构老年人刑事责任年龄、老年人犯罪一律免死、明确对老年犯实行社区矫正等几个方面完善老年人犯罪从宽处罚制度。

Lenient penalty for the elderly crime is a key topic for the studies of criminal law.The Eighth Criminal Law Aendment gives elderly crime lenient penalty,probation and examption from death.Lenient penalty for the elderly crime is rational.We should perfect the mechanism from the following aspects： to low age of the lenient punishment and examption from death,to reconstruct age of criminal responsibility,to exempt death for the elderly crime and to make a clear dividing for elderly prisoners＇ community correction.
